Fundamental information

The Internet offering on the domains www.mahr.com and other top level domains as well as the subdomains metrology.mahr.com, metering.mahr.com and motion.mahr.com (hereinafter collectively referred to as: website) and the body responsible for data protection is Mahr GmbH, Carl-Mahr-Str. 1, 37073 Göttingen (hereinafter referred to as: Mahr Group).

The purpose of this privacy statement is to inform the users of this website as to the kind of personal information collected and used by the Mahr Group as well as its scope and purpose.

The Mahr Group takes the protection of your data very seriously and handles your personal data confidentially and in accordance with statutory regulations. Changes may be made to this privacy statement as a result of new technologies and the constant development of this website. We recommend that you read the privacy statement again at regular intervals.

Unless otherwise specified in detail, our service providers and partners mentioned here process your personal data, transferred when using our website, in third countries either on the basis of an adequacy decision of the EU Commission pursuant to Art. 45 DSGVO (see under https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/adequacy-decisions_de) or on the basis of an order processing contract using the EU standard contractual clauses pursuant to Art. 46 II lit. c) u. d) DSGVO; in this, the provider has undertaken to comply with EU data protection standards.

Access data

Based on its legitimate interest (see Art. 6 para. 1 lit. f. GDPR), the Mahr Group collects data regarding access to the website and stores this data as "server log files" on the website server. The following data are recorded in this way:

  • time at time of access
  • amount of data sent in bytes
  • source/link that led you to the site
  • browser used
  • operating system used
  • IP address used

The server log files are stored for a maximum of 7 days and then deleted. The data is stored for security reasons, e.g. to be able to resolve cases of abuse. If data must be kept to be used as proof, the data are exempt from deletion until the incident has been resolved.

You can also visit this website without providing any personal information. However, to improve our online offering, we do store your access data (without personal reference) to this website. CRM tools are used to collect and process personal data.

In marketing, the data is used to:

Data transmission for the purchase and dispatch of goods upon conclusion of contract

Personal data will only be transferred to third parties if necessary in the context of contract processing. Third parties may include payment service providers or logistics companies, for example. No further data transfer will occur unless you have given your express consent.

The basis for data processing is Art. 6 para. 1 lit. b of the GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

Comments and posts

Your IP address will be saved if you leave a post or comment on this website. This is done on the basis of our legitimate interests in accordance with Art. 6 para. 1 lit. f. of the GDPR and acts as security measure for the Mahr Group.

If your comment is in violation of the law, we can be prosecuted for it. For this reason, it is in our interest to know the identity of the person who authored the comment or post.

On the basis of our legitimate interests in the optimization and analysis of our online offering as defined in Art. 6 para. 1 lit. f. of the GDPR, this website uses the "Google Analytics" service, which is provided by Google Inc. Newsletter subscription

The Mahr Group puts out a newsletter to keep you informed about current events and offers. If you would like to subscribe to the newsletter, you must provide a valid e-mail address. By subscribing to the newsletter, you agree to receive the newsletter and you agree to the procedures as explained.

Revocation and termination: You can withdraw your consent to receive the newsletter at any time, effectively cancelling the newsletter subscription. After your subscription is cancelled your personal data will be deleted. Your consent to receive the newsletter expires at the same time. You can find the link to cancel your subscription at the end of each newsletter.

Product recommendations

The Mahr Group regularly sends you product recommendations by e-mail, independently of the newsletter. This allows us to send you information about products in our range that may interest you based on goods or services you have recently purchased from us. We comply strictly with all legal requirements in the process. You can object to this at any time without incurring any costs other than the transmission costs in accordance with the basic rates. To object, simply send a text message to the contact info mentioned in clause 1 (e.g. e-mail, fax, letter). There is also, of course, an unsubscribe link in every e-mail.

The legal basis for this is the legal permission pursuant to Art. 6 para. 1 pg. 1 f) of the GDPR in conjunction with § 7 para. 3 of the German Act against Unfair Competition [UWG].

Contract fulfillment and payment processing

Service provider

Components from Novalnet AG are integrated on this website. Novalnet AG is a full payment service provider that handles payment processing, among other things.

If the data subject selects a payment method during the ordering process in the online store, data of the data subject is automatically transmitted to Novalnet AG. By selecting a payment option, the data subject consents to this transmission of personal data for the purpose of processing the payment.

The personal data transmitted to Novalnet are usually first name, last name, address, gender, e-mail address, IP address and, if applicable, date of birth, telephone number, cell phone number and other data necessary for the processing of a payment. Also necessary for the processing of the purchase contract are such personal data that are related to the respective order. In particular, there may be a mutual exchange of payment information, such as bank details, card number, validity date and CVC code, data on goods and services, prices.
The purpose of the data transfer is, in particular, identity verification, payment administration and fraud prevention. The person responsible for the processing will transmit personal data to Novalnet AG in particular if there is a legitimate interest for the transmission. The personal data exchanged between Novalnet AG and Mahr may be transmitted by Novalnet AG to credit agencies. The purpose of this transmission is to check identity and creditworthiness.

Novalnet AG also passes on the personal data to service providers or subcontractors, insofar as this is necessary for the fulfillment of contractual obligations or the data is to be processed.

The data subject has the possibility to revoke the consent to the handling of personal data at any time vis-à-vis Novalnet AG. A revocation does not affect personal data that must necessarily be processed, used or transmitted for (contractual) payment processing.

Payment guarantee assignment

In case of payment via the payment methods "credit card",  "PayPal" and "Instant bank transfer" the purchase price claim is assigned via No-valnet AG as payment institution to Financial Management Solutions GmbH (under the brand InfinitePay), (hereinafter referred to as "InfinitePay"). The data required for payment processing is transmitted to InfinitePay.

The data transmission serves, among other things, the purpose that InfinitePay can carry out an identity and credit check for the processing of your purchase with the payment method requested by you. The processing is carried out on the basis of Art. 6 para. 1 lit. f DSGVO from the legitimate interest in offering different payment methods as well as the legitimate interest in protection against payment default. You have the right to object at any time to this processing of personal data relating to you based on Art. 6 (1) (f) DSGVO for reasons arising from your particular situation by notifying us.

Rights of the user

Right to information

You have the right to request confirmation as to whether personal data concerning you is being processed by us and the right to obtain information about your personal data that is being processed by us in accordance with Art. 15 DSGVO.

Right to rectification

You have the right to rectification but also completion of your data according to Art. 16. DSGVO.

Right to deletion

You have the right to immediate deletion of your personal data ("right to be forgotten") according to Art. 17 DSGVO,

  • if they are no longer needed,
  • if you have objected for reasons of a special situation with you and on our side the legitimate interests do not prevail,
  • if the data is processed unlawfully,
  • the deletion is necessary for the fulfillment of a legal obligation.


Right to restriction

You have the right to restrict the processing of your personal data within the scope of Art. 18 DSGVO,

  • if you dispute the accuracy of your personal data while we are verifying the accuracy of your personal data.
  • If the processing of your personal data is unlawful.
  • if your data is no longer required by us, but you need it to assert, exercise or defend legal claims.
  • if you have objected to the processing of your data and it is still unclear whether our legitimate interest prevails.
     

Portability

You have the right to portability of your data in accordance with Art. 20 DSGVO.
